User Agreement - plearning Welcome to "plearning" ("the platform" or "the app"). The platform is provided and operated by plearning ("we" or "us"). These Terms of Service ("the Terms") are written in English. This agreement is the legal contract between you and plearning. In the event that any translated version of the Terms conflicts with the English version, the English version shall prevail. 1. Special Notices 1.1 This User Agreement for plearning (this "Agreement") governs your use of our services (hereinafter referred to as "the Services"), including the online course and training platform we have developed. For the purposes of this Agreement, you and plearning will collectively be referred to as "the parties" and individually as "the party." 1.2 By using our Services or by clicking "Sign Up" during the registration process, you agree to all the terms of this Agreement. We may, at our sole discretion, revise this Agreement from time to time, and the current version will be found at the following link: About Us > User Agreement. By continuing to use our Services, you agree to be bound by the amended Agreement. 1.3 You may only use our Service if you are 16 years of age or older and not subject to the legal age limit for entering into this Agreement under the laws and regulations applicable in Egypt. If you are under the minimum age mentioned above, you may not use plearning unless you have provided valid consent from a parent or guardian. You may not falsely claim that you have reached the minimum age. 1.4 You will be solely responsible for maintaining your plearning account and password. All conduct and activities carried out through your plearning account will be considered actions and activities for which you are solely responsible. 2. Content of the Services 2.1 We reserve the right to change the content of our Services from time to time at our discretion, with or without notice. 2.2 Some services offered by plearning require payment. For paid services, plearning will provide you with prior explicit notice, and you may only access these services if you agree to and pay the applicable fees. If you choose to refuse to pay the applicable fees, plearning will not be obligated to provide you with these paid services. 2.3 The plearning system may require scheduled or unscheduled repairs and maintenance. If such situations result in a reasonable interruption of paid services, plearning will not be liable to you and/or any third party. However, plearning must provide you with notice as soon as possible. 2.4 plearning has the right to suspend, terminate, or restrict the provision of services under this Agreement at any time and is not obligated to bear any liability to you or any third party in the event of any of the following occurrences: 2.4.1 You are under the minimum age to receive plearning services; 2.4.2 You violate the terms of use set forth in this Agreement; 2.4.3 Your failure to make payment for the use of paid services. 2.5 Except for the express representations and warranties set forth in this Agreement, plearning does not provide any warranties regarding the subject matter of this Agreement and disclaims any and all other warranties, whether legal, express, or implied. 3. Privacy You acknowledge that you have read and fully understand our Privacy Policy, which describes how we handle the data you provide us or that is generated when you use our Services. Virtual Items 4.1 You may only purchase virtual items (such as courses) and send them to others or receive gifts of monetary value. 4.2 The price of items will be displayed at the point of purchase. All fees and payments for products will be paid in the currency specified at the point of purchase through the relevant payment mechanism. 4.3 You will be responsible for paying for any products you purchase. Once the purchase process is complete, the product will be added to your user account. Products cannot be exchanged for cash or legal tender. 4.4 Except as otherwise provided in this Agreement, all sales of products are final, and we do not offer refunds for any products purchased. 5. Disclaimer 6.1 You assume full responsibility for any risks that may arise from using plearning Services. Any use or reliance on plearning Services will be at your own risk. 6.2 plearning does not guarantee that the Services will meet your requirements or that the Services will be uninterrupted. You acknowledge and agree that the Services are provided by plearning on an "as is" basis. 6.3 plearning does not guarantee the accuracy and safety of any external links accessible using the Services. 6.4 plearning will not be liable for service interruptions or other deficiencies due to force majeure or circumstances beyond plearning's control. 7. Other Terms 7.1 This Agreement constitutes the entire agreement of the parties regarding the agreed terms and related matters. Unless otherwise provided in this Agreement, no additional rights are granted to either party. 7.2 If any provision of this Agreement is found to be invalid or unenforceable by a competent authority, in whole or in part, for any reason, the remaining provisions of this Agreement shall remain in full force and effect. 7.3 Headings in this Agreement are for convenience only and should be disregarded in interpreting this Agreement. 8. Governing Law These Terms of Service and any separate agreements we provide you with regarding the Services shall be governed by the laws of the Arab Republic of Egypt and interpreted accordingly. 9.
